By accessing and using NotifyGate ("Service"), you accept and agree to be bound by the terms and provisions of this agreement. If you do not agree to these Terms of Service, please do not use the Service.

2. Description of Service

NotifyGate is a notification gateway service that provides event routing, transformation, and delivery to multiple notification channels. The Service includes:

  • Event ingestion and processing
  • Rule-based routing and transformation
  • Multi-channel notification delivery
  • Event logging and analytics
  • API access and integrations

3. Account Registration

To use the Service, you must:

  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Be at least 13 years of age
  • Notify us immediately of any unauthorized use

You are responsible for all activities that occur under your account.

4. Acceptable Use

You agree not to use the Service to:

  • Send spam or unsolicited communications
  • Violate any laws or regulations
  • Infringe on intellectual property rights
  • Transmit malicious code or viruses
  • Attempt to gain unauthorized access
  • Interfere with the Service or other users
  • Use the Service for illegal activities

5. Subscription Plans and Billing

5.1 Plans

We offer multiple subscription plans (Hobby, Starter, Pro) with different features and usage limits. Current plan details are available on our pricing page.

5.2 Payment

Paid plans are billed monthly or annually. You authorize us to charge your payment method on a recurring basis. Prices are subject to change with 30 days notice.

5.3 Refunds

We offer a 14-day money-back guarantee for new paid subscriptions. No refunds are provided for partial months or years.

6. Service Levels and Uptime

We strive to maintain high availability but do not guarantee uninterrupted service. We are not liable for:

  • Scheduled maintenance
  • Force majeure events
  • Third-party service failures
  • Network or infrastructure issues

7. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. We retain event data according to your subscription plan and may use aggregated, anonymized data for service improvement.

8. Intellectual Property

The Service and its original content, features, and functionality are owned by NotifyGate and are protected by international copyright, trademark, and other intellectual property laws.

You retain ownership of your event data and content. By using the Service, you grant us a license to process and deliver your events according to your configurations.

9. API Usage

API access is subject to rate limits based on your subscription plan. We reserve the right to:

  • Throttle or block abusive API usage
  • Change API endpoints with reasonable notice
  • Deprecate API versions with 90 days notice

10. Termination

We may terminate or suspend your account if you:

  • Violate these Terms of Service
  • Fail to pay fees when due
  • Engage in fraudulent activity
  • Abuse the Service

You may cancel your account at any time through the dashboard. Upon termination, your access to the Service will cease, and your data will be deleted according to our retention policy.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Merchantability
  • Fitness for a particular purpose
  • Non-infringement
  • Accuracy or completeness

12. Limitation of Liability

To the maximum extent permitted by law, NotifyGate shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or other intangible losses.

Our total liability for any claim arising out of these terms shall not exceed the amount you paid us in the 12 months preceding the claim.

13. Indemnification

You agree to indemnify and hold NotifyGate harmless from any claims, damages, or expenses arising from your use of the Service, violation of these terms, or infringement of any rights of another party.

14. Changes to Terms

We reserve the right to modify these terms at any time. Material changes will be communicated via email or through the Service. Continued use after changes constitutes acceptance of the modified terms.

15. Governing Law

These terms shall be governed by and construed in accordance with the laws of the jurisdiction in which NotifyGate operates, without regard to conflict of law provisions.
